Welcome to Heavenly + Co. By accessing www.heavenly.my or placing an order, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use our website or services.

2. Eligibility
You confirm that you are able to enter into a binding contract under Malaysian law and that information you provide (including delivery details) is accurate and complete.
3. Products and descriptions
We sell slow-roasted nuts, nut mixes, dried fruits, seeds, pantry items, gifts, and related products. We try to display products accurately; however:
• Natural products may vary slightly in colour, size, texture, and appearance
• Photos are for illustration and may not match every batch exactly
• Packaging may change without notice
If a product is unavailable after you order, we will contact you with options (replacement, partial refund, or full refund).
4. Roasted on order
Many nuts and seeds are roasted after you place your order to maximise freshness. This may mean slightly longer processing time before dispatch compared with pre-packed warehouse stock. Estimated delivery timelines are guidance only and may vary.
5. Pricing and payment
• Prices are listed in Malaysian Ringgit (MYR) unless stated otherwise
• Prices and promotions may change at any time before you complete checkout
• You are responsible for applicable taxes if any
• Payment must be completed through the methods offered at checkout
• We reserve the right to cancel orders that appear fraudulent, erroneous, or unpayable
6. Orders
When you place an order, you make an offer to purchase. Order acceptance occurs when we confirm and/or process the order. We may refuse or cancel an order (for example stock issues, pricing errors, or suspected fraud). If already paid, we will refund eligible amounts.
7. Shipping and delivery
• We deliver within Malaysia (West and East Malaysia)
• Free shipping may apply on qualifying orders (e.g. RM60 and above for West Malaysia, as stated on our site / at checkout)
• East Malaysia shipping fees and timelines may differ and are shown at checkout
• Typical West Malaysia delivery after dispatch is about 2–5 working days, subject to courier and location
• Risk of loss passes to you upon delivery to the address provided (or as otherwise determined under courier terms)
Please ensure your address and contact number are correct. Extra courier fees caused by failed delivery, address errors, or re-delivery may be charged to you.

8. Allergen notice
Our products include nuts, seeds, and other allergens, and are prepared in facilities that handle allergens. If you have allergies or dietary restrictions, read product information carefully and contact us before ordering if unsure. You are responsible for checking suitability before consumption.
9. Returns and refunds
Returns, replacements, and refunds are governed by our Refund Policy. By ordering, you also agree to that policy.
10. Promotions
Promotions, vouchers, and free-shipping offers are subject to their stated terms, including minimum spend, validity dates, and exclusions. We may modify or end promotions at any time.
11. Intellectual property
All content on this website (logos, text, images, graphics, product names, and design) belongs to Heavenly + Co. or its licensors. You may not copy, reuse, or distribute our content without prior written permission.

You agree not to:
• Misuse the website or attempt unauthorised access
• Submit false information
• Interfere with site security or other users
• Use our content or brand in a misleading way
13. Limitation of liability
To the fullest extent permitted by Malaysian law:
• We are not liable for indirect, incidental, or consequential losses (including loss of profits, data, or goodwill)
• Our total liability for any order is limited to the amount you paid for that order
• Nothing in these Terms excludes liability that cannot be excluded by law (including for fraud or personal injury caused by negligence where such exclusion is not allowed)
14. Indemnity
You agree to indemnify Heavenly + Co. against claims arising from your misuse of the site, breach of these Terms, or inaccurate information you provide, to the extent permitted by law.

Our collection and use of personal data is described in our Privacy Policy.
16. Changes to the website or Terms
We may update products, prices, content, and these Terms at any time. The “Last updated” date will change when Terms are revised. Continued use of the site after changes means you accept the updated Terms.
17. Governing law
These Terms are governed by the laws of Malaysia. Disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia, without prejudice to any mandatory consumer rights you may have.
